General introduction
➢ Shipping law (scheepvaartrecht): commercieel recht, tussen private partijen of tussen private
partijen en de overheid.
➔ Contracten
• Traditional: scheepvaartrecht is oud
• Self-regulation: recht komt uit de praktijk
• Universally: conventies zorgen ervoor dat overal hetzelfde recht wordt toegepast binnen
de zeevaart. Scheepvaartrecht is dus in vele landen gelijk.
• Specificity.
➢ Law of the sea: internationaal recht, niet commercieel, geen private partijen.

Organisations of international law:
✓ IMO (1948) (International Maritime Organisation)
Intergouvernementele organisatie die instaat voor veilig en efficiënte scheepvaart op schone
oceanen.
Bestaat uit een ‘assembly’ (algemene vergadering), een comité en subcomitté en een council,
bestaande uit 40 leden. De counsil wordt opgedeeld in 3 categorieën:
o Category a: 10 states with the largest interest in providing international shipping services.
o Category b: 10 states with the largest interest in international seaborn trade.
o Category c: 20 states not elected under a or b above, which have special interests in
maritime transport or navigation and whose election to the counsil will ensure the
representation of all major geographic areas of the world. (België)

CASE
French crewing requirements: A French law which provided that a proportion of the crew of a
French flagged vessel must be French nationals, was contrary to the rules relating to the free
movement of workers.
TFEU: Treaty on the Functioning of the European Union: Weinig specifieke vermelding van
zeevaart maar alles wat in het document staat, is van toepassing op zeevaart (ART 100)

, CASE
Flinterstar: gezonken schip voor de kust van Zeebrugge zorgde voor een juridische strijd. De rederij van
het schip nam formeel afstand van het schip. Er zaten gaten in de juridische nationale regeling waardoor
de Belgische staat zelf instond voor de berging en de kosten ervan.
In het nieuw wetboek werden regelingen opgenomen om dit te voorkomen. Zo kan de overheid
een rederij dwingen om een wrak te bergen zonder dat de rederij daar iets tegenin kan
brengen
Nieuw Belgisch Scheepvaartwetboek (1 sept 2020):
- Belang?
- Welke veranderingen?
De totstandkoming van het nieuw wetboek was een werk van lange adem:
• De Federale Commissie stelt een nieuw ontwerp op, meteen gevolgd door opmerkingen /
ontevredenheid van betrokken sectoren (verzekeringen, terminals, scheepsagenten…)
• Stukken worden uit het wetboek gehaald omdat er geen consentie wordt bereikt en een nieuw
finaal ontwerp wordt opgesteld door de commissie.
• Toevoegingen door de overheid & vertaling naar het Frans want België is een federaal land. (duurt
ook heel lang want men moet de juiste Franse termen opnemen)
Veranderingen:
• In het wetboek werden definities opgenomen om discussies omtrent concepten op te lossen en te
vermijden.
• Charterparties: aanvullend recht
• Oude wetten werden geschrapt en andere nieuwe wetten werden geïncorporeerd.
• Geen opname van verzekeringen, terminals, scheepsagenten, …
