Natuurlijke personen:

Mensen van vlees en bloed. Gedurende zijn hele leven is de mens rechtssubject, drager van rechten en plichten. Het verschijnsel noemen we rechtssubjectiviteit. Bij de dood eindigt de rechtssubjectiviteit en gaan de rechten en plichten of over op de erfgenamen of teniet.

Het BW kent de volgende zakelijke rechten:

opstal; erfpacht; erfdienstbaarheid; deze rechten zijn afgeleid van het eigendomsrecht en kunnen alleen op een zaak betrekking hebben.

De natuurlijke verbintenis:

Dit is een rechtens niet afdwingbare verbintenis, zo luidt de definitie in art. 6:3 lid 1 BW. Bij een gewone verbintenis heeft de crediteur de mogelijkheid via de rechter de debiteur tot nakoming te dwingen: aan de vordering is een processueel recht verbonden. Dit processuele recht ontbreekt bij de natuurlijke verbintenis.
