Employment Equity Act (EEA):

- designed to redress inequalities of the past - done through affirmative action - equal representation at all levels of the workplace - training, promotion and remuneration - Positives: imbalances and unfairness of the past is corrected, more diverse workplace - Negatives: additional workload, necessary skills aren't always available, lack of respect for skills, knowledge and competencies, skills have been lost to other countries

Broad Based Black Economic Empowerment Act (BBBEE):

- aims to redress imbalances of the past by bringing the black majority of the country into the economic mainstream - Five elements/pillars: 1. black ownership 2. management level in the businesses 3. skills development 4. black-owned business as the suppliers 5. socio-economic development - Positives: improved standards of living, increased opportunities, increased skills development - Negatives: majority have not benefited, skills and experience is limited

Unfair dismissal part of the LRA:

- constructive dismissal (forces employee to resign) - employee legally participates in activities of a trade union/workplace forum - employee taking part in protected strike - dismissed due to pregnancy - no appropriate notice - arbitrary factors - Remedies for unfair dismissal: re-employment, compensation, combination
