, WHAT IS LABOUR LAW
Labour law can be defined as a body of legal rules that regulate relationships between
employers and employees,
trade unions and employers
employers’ organisations and trade unions.
These rules are legally enforceable, by specific legislation and may approach a cou

Focuses on relationships on a collective level.

Common Law:
At common law the employer and employee relationship is one that is an equal due to the
bargaining power that is wielded by the employer.
The common law does not support or recognise any collective bargaining as a means to
restore equality in the power relationship between employer and employees.
