1.1 Study this image and identify the crime that was committed. Supply the
reason(s) for identifying this specific crime. (5)




The image depicts an individual forcibly opening a window to gain access to a residential
dwelling. The crime being committed is housebreaking (Study Guide OVM2602, Unit 3,
p. 38).


I reached this conclusion by examining the essential components of the offence. The
person's actions are clearly unlawful as there is no indication of permission from the
property owner. The physical act of forcing the window open satisfies the requirement of
breaking, which involves overcoming any obstacle that blocks entry. So inserting a hand
or body through the opening, the individual completes the act of entering a structure.
Since the target is a home, it qualifies as a building or structure intended for human
habitation, further confirming that housebreaking has occurred.
