Assume that copyright subsists in the recording and the broadcast comprising the aired radio
interview. Who is/are the likely authors and owners of the copyright in these works?
In terms of the Copyright Act 98 of 1978, copyright protection extends to a variety of works,
including sound recordings and broadcasts. For a sound recording, the author is the person by
whom the arrangements for the making of the recording were made, usually the producer or the
broadcasting organisation’s employees. In this case, the radio station that organised, arranged
and technically produced the recording of the interview would be regarded as the author. Since
the recording was made in the course and scope of employment, the employer (radio station)
would also be the first owner of copyright under section 21(1)(d).
Similarly, for a broadcast, the Copyright Act provides that the broadcaster who takes the
initiative and responsibility for transmitting the broadcast is both author and owner of the
copyright. Here, the radio station is the party that arranged the transmission of the interview to
the public, and it therefore enjoys copyright in the broadcast as well.
Thus, the likely authors and owners of the copyright in both the recording and the broadcast are
the radio station and not the individual interviewer or interviewee.
