Introduction to Chapter 3 of the South African Constitution: Co-operative
Government



Chapter 3 of the Constitution of the Republic of South Africa, 1996 outlines the
principles of co-operative government and intergovernmental relations, providing
the foundation for how the national, provincial, and local spheres of government should
interact. This chapter was introduced to address South Africa’s historical challenges of
centralized governance and uneven development by promoting a framework based on
collaboration, mutual respect, and effective coordination.

Section 40(1) describes the three spheres of government as “distinctive,
interdependent and interrelated.” This means that while each sphere has its own
constitutional status and powers, they are expected to function in partnership. Section
41 further sets out the principles of co-operative governance, which include acting in
good faith, fostering friendly relations, and resolving disputes through negotiation and
mediation rather than adversarial litigation.

These provisions are particularly relevant in complex sectors like education, where
responsibilities are shared across all levels of government. For example, while the
national government determines overall policy and standards, provincial governments
are responsible for implementation, and local authorities often contribute through
infrastructure and community support.
