Enrichment Liability and Estoppel
QUESTION 1
Discuss in general (without reference to a specific enrichment action) how the
extent of enrichment liability (or the quantum of the enrichment claim) will be
calculated.
In South African law, enrichment liability arises when one party is unjustifiably enriched
at the expense of another. The extent of enrichment liability, or quantum, is not based
on the value transferred by the plaintiff but rather on the value the defendant retains at
the time the claim is brought. The aim is not to punish the enriched party but to restore
the financial position of the impoverished party as far as possible without resulting in
unjust outcomes.
The first principle is that the amount of enrichment is determined at the time of the
institution of the action. This ensures that only the value remaining in the hands of the
enriched party is recoverable, not what was originally transferred.
The second principle is the maximum amount recoverable is limited to the extent of the
actual enrichment. If the benefit has been diminished or no longer exists, the claim must
be reduced accordingly. The law does not allow recovery for enrichment that no longer
benefits the defendant.
