the Third World. This approach critiques the ways in which international legal norms and
institutions have historically advanced the interests of dominant Western powers while
systematically sidelining the voices, experiences, and concerns of developing nations—
particularly those with legacies of colonization and imperial exploitation.

1.2 What inspired the emergence of the TWAIL movement?

The TWAIL movement was principally driven by the historical and ongoing impact of
colonialism and imperialism on the Global South, particularly in Africa, Asia, Latin
America, and the Caribbean. During the colonial era, international legal principles—
such as the doctrine of terra nullius and the so-called “standard of civilization”—were
employed by European empires to legitimize the conquest, occupation, and resource
extraction from non-European societies.

Following formal decolonization, many postcolonial states observed that the global legal
system continued to reflect the same structural inequalities and biases that
characterized colonial rule. Institutions such as the United Nations, International
Monetary Fund (IMF), and World Bank often remained under the influence of former
colonial powers, and international legal norms frequently failed to address the socio-
economic and political realities of the Global South.

In response, TWAIL scholars and legal practitioners began to question and resist the
