1.1 What does the acronym TWAIL stand for?
TWAIL stands for Third World Approaches to International Law. It is more than a
name—it is a way of thinking that questions how international law has been shaped to
benefit powerful Western countries. TWAIL argues that international law has often
ignored or harmed the interests of Third World countries, especially during and after
colonialism. By using TWAIL, we can look at key legal ideas like sovereignty,
development, and human rights through the lens of formerly colonized states. This
helps us understand whose voices are missing and whose power is being protected.
1.2 What informed the development of the TWAIL movement?
TWAIL developed in response to specific historical experiences and academic critiques.
The main influences include:
Colonial legacy and Eurocentrism
TWAIL highlights how early international law helped justify colonial rule. Doctrines like
terra nullius treated non-European lands as empty, allowing European powers to claim
them. This history shows that international law was not created fairly—it was built to
serve colonial goals. Understanding this helps explain why international law still favors
powerful countries.
