Explain what it means when a court has jurisdiction over a matter.
Jurisdiction refers to the legal authority or power that a court has to hear and decide a
particular case. When a court has jurisdiction over a matter, it means the court is legally
empowered to:
Hear the case (accept it into its court roll),
Consider the evidence,
Make rulings based on the law, and
Deliver a binding judgment or sentence.
This authority is determined by factors such as:
Geographical location – where the crime or incident took place,
Type of matter – whether it’s a criminal, civil, or constitutional issue,
Severity of the offence or value involved, and
Whether the parties involved fall within the court’s legal reach.
Without proper jurisdiction, any decision made by a court is considered invalid and can
be overturned.
