1.1 Form of Sexual Harassment Depicted in the Case Study (15 marks)
The form of sexual harassment depicted in the case study is quid pro quo sexual
harassment. This type of harassment occurs when a person in a position of authority
makes sexual advances towards a subordinate in exchange for employment benefits,
such as promotions or job security.
Reasons for this classification:
Ms. C is in a supervisory position over Mr. A, which creates a power imbalance.
She makes unwelcome flirtatious comments that make Mr. A uncomfortable.
She invites Mr. A to her house under the pretense of work, where she sets up a
romantic dinner.
She requests physical contact (a back massage) and makes suggestive
remarks about advancing their relationship.
She promises a promotion in exchange for compliance, which constitutes an
abuse of power.
Quid pro quo harassment is unlawful under South African employment and labour
laws, including the Employment Equity Act (EEA) 55 of 1998 and the Code of Good
Practice on the Handling of Sexual Harassment Cases in the Workplace.
