The Enforcement Mechanisms of the Convention on the Rights of Persons with
Disabilities (CRPD)

Introduction

The Convention on the Rights of Persons with Disabilities (CRPD) is a key international
human rights treaty that aims to protect and promote the rights of persons with
disabilities. Adopted by the United Nations (UN) in 2006 and coming into force in 2008,
the CRPD represents a shift from viewing persons with disabilities as objects of charity
to recognizing them as individuals with rights (United Nations, 2006). However, for any
treaty to be effective, there must be strong mechanisms to ensure that states comply
with their obligations. This essay discusses the enforcement mechanisms of the CRPD
and examines whether it provides for individual complaints.

The Role of the Committee on the Rights of Persons with Disabilities

One of the primary enforcement mechanisms of the CRPD is the Committee on the
Rights of Persons with Disabilities (the Committee). This Committee is made up of
independent experts who oversee the implementation of the CRPD by state parties (UN
General Assembly, 2006). Countries that have ratified the CRPD are required to submit
regular reports on the steps they have taken to implement the treaty. These reports
must be submitted within two years of ratification and every four years thereafter (United
Nations, 2021).
