Question 1. John Masupa and Sophie Masupa are
married in community of property and own Erf 27
Sunrise Township. John dies and according to his
will, all his assets are bequeathed to Sophie.
Sophie is therefore entitled to ½ (one-half) share of
the property by virtue of her marriage in
community of property to John, and the other ½
(one-half) share by virtue of the bequest in John’s
will. 1.1. How will you transfer John’s ½ (one-half)
share to Sophie other than by way of deed of
transfer? (3)
John’s ½ share in Erf 27 Sunrise Township can be transferred to Sophie by means
of an endorsement in terms of Section 45 of the Deeds Registries Act 47 of
1937. This is an alternative to a deed of transfer. The process involves:

1. Application for an endorsement – Sophie, as the surviving spouse, must
apply to the Deeds Office for an endorsement in terms of Section 45(1) of
the Act.
2. Supporting documents – The application must be accompanied by John's
death certificate, their marriage certificate, and a certified copy of the
will confirming that Sophie is the sole heir.
3. Registrar’s endorsement – If all requirements are met, the Registrar of
Deeds will endorse the existing title deed, reflecting Sophie as the sole
owner of the property without the need for a new deed of transfer.

transfer.
