Karabo has suffered a financial loss of R50,000 due to an unknown individual cloning his
bank card and withdrawing funds from his bank account. The key legal question is whether
this person, when identified, can be charged with fraud or any other crime.
Definition of Fraud
Fraud is the unlawful and intentional making of a misrepresentation that causes actual or
potential prejudice to another person. South African law requires the following elements for
fraud to be established:
A misrepresentation must be made;
The misrepresentation must be unlawful;
The misrepresentation must be made with intent (dolus);
