Yes, I would advise ADB Cables to use the Provisional Sentence Procedure in a bid to
recover the amount due. The Provisional Sentence Procedure is a quick judicial process
aimed at allowing a creditor to invoke quick judgment on the basis of a liquid document
such as an Acknowledgement of Debt (AOD). The process is proved to be most
efficacious where no dispute over the debt exists and the debt is orally admitted by the
debtor.
Grounds for recommending the Provisional Sentence Procedure:
1. Liquid Document: The AOD signed by Brown Electrical is a liquid document since it
clearly recognizes the debt and amount due. A liquid document is a condition precedent
to provisional sentence proceedings (Standard Bank of South Africa Ltd v ROC Portfolios 101

2. Effectiveness and Promptness: Provisional sentence process is more effective than
