QUESTION 1: LAND ISSUES AND PRINCIPLES
(a) The Form of Leasehold Introduced by the Blacks (Urban Areas) Consolidation
Act 25 of 1945
The Blacks (Urban Areas) Consolidation Act 25 of 1945 was one of the laws that
controlled where Black South Africans could live and own property in urban areas. The
Act introduced a form of leasehold, which allowed Black people to occupy land in
designated urban areas but not to own it outright. This leasehold system was very
restrictive because it was essentially a permit to stay rather than full ownership rights.
Under this system, Black South Africans could be granted leases for up to 30 years,
but these leases were subject to various conditions, and they could be revoked at any
time by the government. This meant that even though people could build homes and
live in these areas, they had no real security because the government could remove
them if it wanted to. The Act was designed to limit Black landownership and keep urban
areas under white control. It was only later, through democratic reforms, that land laws
started changing to give everyone the right to own property freely.
