Introduction: Rapid Development of Incarceration During the Colonial Period
The development of incarceration systems can be traced back to the colonial period,
where prison systems were established as instruments of control. During this time,
colonial powers used incarceration to maintain their dominance, suppress rebellions,
and punish those who resisted their rule. Prisons were overcrowded and inhumane,
focusing on hard labor rather than reform. Over the years, these systems evolved into
the modern correctional facilities we know today, balancing punishment, deterrence,
and rehabilitation. Currently, incarceration remains a central element of the justice
system, although debates persist about its effectiveness in reducing crime and
rehabilitating offenders.
1.1 Theories of Punishment Supporting John Z.’s Death Sentence
Retribution: This theory focuses on justice and punishment that fits the crime.
John Z.’s violent murders, including that of a partner, make his execution a form
of societal vengeance, ensuring he pays the ultimate price for his actions.
Deterrence: Supporters of the death penalty argue that it serves as a warning to
others, discouraging violent crimes. The fear of facing the death penalty may
prevent others from committing similar offenses.
Incapacitation: Executing John Z. ensures he can never commit another crime,
providing permanent protection for society.
