1. Sentencing Principles and Their Effect on a First-Time Child Offender
South African courts consider the following three sentencing principles when imposing
punishment:
1. Retribution – The punishment should fit the crime and ensure justice is served.
2. Deterrence – The sentence should discourage the offender and others from
committing similar offenses.
3. Rehabilitation – The sentence should aim to reform the offender and reintegrate
them into society.
Effect on a First-Time Child Offender:
Since children are vulnerable and still developing, courts prioritize rehabilitation
over retribution.
A first-time child offender may receive a more lenient sentence, such as diversion
programs, counseling, or community service, instead of direct imprisonment.
The principle of "the best interests of the child" (as per the Child Justice Act 75 of
2008) influences the sentencing process.
2. Threats of Violence in a Homosexual Relationship
