African Customary Law
1. Customary Public Law and Its Subdivision
When we talk about customary public law, we are referring to the system of rules that
govern the relationship between traditional leaders and their subjects within a
community or tribe. This law is deeply rooted in the customs and traditions of the
people, and it helps to maintain order and resolve disputes within the community.
Customary public law can be divided into two main parts:
The relationship between the traditional authorities and their subjects: This
refers to how the chiefs, kings, or other traditional leaders manage their people.
They make decisions, issue commands, and lead the community in various
ways, like resolving disputes or managing communal land.
The relationship between the traditional authorities and the tribe as a
whole: This focuses on the interactions between the leadership and the people
at a larger level, such as community meetings, traditional rituals, and the
distribution of resources like land.
These two parts help maintain a balance of power, keep order, and respect cultural
traditions within the tribe.
