Semester 2 2024 - DUE 16 September 2024
1.1 (a) The Films and Publications Act 65 of 1996
regulates publications by making provision for a system
of classification. Name TWO possible classifications that
can be given to publications and indicate briefly when a
publication will be awarded each of these classifications.
(5) (b) What is “virtual child pornography”? What is the
legal position surrounding the issue of virtual child
pornography? (5)
(a) Two Possible Classifications Under the Films and Publications Act 65 of 1996:

1. "X18" Classification:
o This classification is given to material that contains explicit adult content, such as
sexually explicit conduct, nudity, or graphic depictions of sexual acts.
Publications are awarded this classification when they are deemed suitable only
for adult audiences and must be distributed under controlled conditions, such as
through licensed adult premises.
2. "Refused Classification" (RC):
o A publication is given this classification when its content is deemed to be extreme
or harmful, such as content that incites violence, promotes hate speech, or
involves child pornography. This classification results in the material being
banned from distribution and circulation within South Africa.

(b) Virtual Child Pornography and Its Legal Position:

Virtual child pornography refers to the use of computer-generated images or digital media to
depict sexual acts involving children, even though no real children are involved. It could include
realistic animations, drawings, or manipulated images that resemble child pornography but are
not based on actual children.

Legal position: In South Africa, virtual child pornography is treated similarly to actual child
pornography. The Films and Publications Act 65 of 1996, as amended, criminalizes the
possession, production, and distribution of any material that depicts sexual conduct involving
minors, whether real or simulated, including virtual depictions. The intention is to prevent harm
and the normalization of child exploitation, even if no real child was involved in the creation of
the content.
