1.1 (a) The Films and Publications Act 65 of 1996
regulates publications by making provision for a system
of classification. Name TWO possible classifications that
can be given to publications and indicate briefly when a

legal position surrounding the issue of virtual child
pornography? (5)
(a) Two Possible Classifications under the Films and Publications Act 65 of 1996:

1. PG (Parental Guidance):
o A publication or film may be classified as PG if it contains material that may not
be suitable for young children without adult supervision. This classification is
awarded when there is content such as mild violence or mild language that is not
appropriate for all audiences but is not severe enough to warrant a higher
restriction.
2. X18:
o A publication or film can be classified as X18 if it contains explicit sexual
content. This classification is given to materials that include adult-only content
such as explicit nudity and sexual activity. Materials classified under this category
are only permitted to be distributed in licensed adult shops or restricted areas.

(b) Virtual Child Pornography and Its Legal Position:

 Virtual Child Pornography: This refers to digitally created or manipulated images or
videos that depict children engaged in sexual acts or sexually explicit conduct. These
images may not involve real children, but they give the appearance of child pornography.
 Legal Position: In South Africa, virtual child pornography is treated as seriously as real
child pornography. The Films and Publications Act, along with other legislation like the
Criminal Law (Sexual Offences and Related Matters) Amendment Act, criminalizes the
possession, creation, distribution, and viewing of child pornography, whether real or
virtual. Virtual child pornography is prohibited as it promotes the exploitation of children
and may encourage real-life child abuse.
