SCL1501

Assignment 1

DUE 26 AUGUST 2024

, QUESTION 1

Relationship between the Freedom Charter and the South African Constitution: The
Freedom Charter adopted in 1955 was a document of great centrality in the anti -
apartheid struggle and one that grounded a democratic South Africa. The cardinal
values expressed by the Freedom Charter are that of equality, human rights, and
social justice.

The Constitution of South Africa, born in 1996, gives these principles effect in its
Preamble, which recognizes the injustices of the past and declares the determination
of the people of South Africa to establish a social order in which democratic values,
human rights, and equality for all would be realized.

Chapter 1 of the Constitution sets out the founding provisions, echoing the Charter's
call for a non-racial, non-sexist democracy.

Chapter 2, the Bill of Rights, entrenches rights and freedoms that are in accord with
the requirements of the Freedom Charter, such as the rights to equality, freedom,
and dignity.
