1. Explain the legislative history of the south African citizenship law:

 South African citizenship Act 49 of 1949
 Commonwealth relations Act 69 of1962
 The black Homelands Citizenship Act 26 of 1970
 The Restoration and extension of the south African citizenship act 196 of 1993
 The interim Constitution of 1993
 The Constitution of 1996


2. In terms of the South African Citizenship Act 88 of 1995, there are 3 ways of
acquiring South African citizenship:

 Citizenship by birth
 Citizenship by descent
 Citizenship by naturalisation


3. Citizenship by birth :

 Acquired by anyone who is born in S.A including the nine provinces of S.A.

4. Different ways of acquiring citizenship by birth :

 A person qualifies for the acquisition of S.A.C. by birth if he or she was a S.A.C by
birth immediately prior to the date of commencement of the Citizenship Act 1995, or
was born in the republic on or after the date of commencement of the citizenship act
of 1995.

,  A person qualifies for citizenship by birth even if he or she was not born in South
Africa on or after the date of commencement of the citizenship act 1995. Such a
person will only qualify for citizenship by birth if his or her parents or his or her
mother (if he or she was born out of a wedlock) was:


 in the service of the Government of the Republic of S.A;
 The representative or the employee of a person or an association of persons
resident or established in the republic;
 In the service of an international organisation of which the Government of the
Republic was then a member.

5. Does not qualify for citizenship by birth if at the time of his or her birth one of his
parents:

 Is a person enjoying diplomatic immunity in the republic;
 Is a career representative of the government of another country;
 Is a person employed in the embassy of such a government;
 Person employed in the office of such a career representative;
 Person is a member of the household or an employee of any such person;
 Or has not been lawfully admitted to the republic for permanent residence and his or
her other parents was not a South Africa citizen.

6. A person born of such parents only qualifies for citizenship by birth if :

 He or she is legally adopted by a south African citizen
 He or she does not have the citizenship or nationality of any other country or has
not right to such citizenship
 His or her birth is registered in the republic in accordance with the Birth and Deaths
Registration Act 51 of 1992
