THE LEGAL PROFESSION
1.1 Read the following scenario and answer the questions that
follow: Sandra and Mary are twins from Soshanguve, Pretoria. They
have recently graduated from the University of Ariyeng. Sandra
completed the LLB degree, while Mary completed a Business
Management degree. Sandra is now practicing as a candidate
attorney at a top law firm in Pretoria, while Mary has just opened a
clothing shop. One evening, Sandra tells her twin sister that she
(Sandra), as a candidate attorney, is suspicious of professional
codes that regulate her profession.
(a) Explain the meaning of the term “profession” and describe how
a legal practitioner should carry out his/her duties in terms of the
meaning of a “profession”. (4)
, (b) In view of the above scenario, explain how Sandra’s profession,
is different from a business or trade, which Mary has ventured into,
by referring to any three characteristics of a “profession”. (3)
(c) In view of Sandra’s statement that she is “suspicious of
professional codes”, name and discuss the two types of concerns
that Sandra may have with professional codes and indicate whether
these concerns are valid or not. (8)
1.2 Explain what a professional code is and list any three general
aims of a code of legal ethics. (5)
1.3 Consider the following statement and answer the question that
follows: “Objectivity is closely related to good judgment and also to
honesty”. Discuss “objectivity” as a core value of a “good lawyer”.

(a) The term "profession" refers to a vocation or occupation that requires
specialized knowledge, training, and skills, often with a regulatory body
overseeing standards and ethical conduct. A legal practitioner should
carry out their duties with integrity, confidentiality, competence, and loyalty
to clients, while upholding the principles of justice and fairness.
