of learners who experience barriers to learning in the school environment

1.1 The Constitution of South Africa (Act 108 of 1996) [5]

The constitution of South Africa (Act 108) of 1996:This legislation is aimed at upholding the rights
of all individuals ,including learners who experience barriers to learning,and ensuring equal access
to education .The Constitution of South Africa provides a legal framework .It emphasizes the
principles of non-discrimination ,equality and inclusivity .The constitution guarantees the right to
education for all learners ,without any form of discrimination. Including those learners with
disabilities or special needs. This means that schools are legally obligated to accommodate the
diverse needs of learners who experience barriers to learning, whether it be due to disability ,socio
economic factors, or other reasons .This legislation provides a strong foundation for inclusive
education practices.

1.2. The Convention on the rights of the child [5]

This international treaty outlines the rights and protections that should be afforded to all
children ,including those with barriers to learning. The convention stresses the importance of child-
friendly education ,where every child has the right to access quality education that suits their
individual needs and abilities. Schools are encouraged to provide necessary support and
accomodations to learning ensuring their right to participate and achieve their full potential
