Explain the legal and ethical issues in relation to the use of business information
Legal issues
There are quite a few legislations that aim to protect the use of business information. All
legislations need to be taken into consideration by businesses; however the main legal issues I
will be talking about are the Data Protection Act 1998, the Computer Misuse Act 1990 and
the Freedom of Information Act 2000.
Data Protection Act 1998
The Data Protection Act 1998 was created in order to protect individual’s data in the way it is
used. For businesses such as Taylor Wimpey, this legislation means that they may hold
information such as names, home addresses, mobile phone numbers and bank details as long
the information on their database is:
Collected lawfully and fairly
Not kept for longer than necessary
Used only for the purpose said when the information was collected
Subject to procedure to prevent unlawful processing, accidental loss, destruction and
the damage to personal data
Protected from being transferred to an area outside of the European Economic Area
(EEA) unless there is suitable protection existing for data in that specific area.
Taylor Wimpey collects personal information of their customers such as names, email
addresses, home addresses, telephone numbers and payment information. Taylor Wimpey has
a privacy policy stating how they will use the personal information of customers.
