THE PURPOSE DOCUMENT IS NOT TO PROVIDE YOU WIGH WITH COPY AND PASTE TEMPLATE. HOWEVER ITS MEANT TO GUIDE YOU OF WHAT IS EXPECTED FROM YOU IN THIS ASSIGNMENT. You are a candidate attorney working at a law firm that specialises in child justice. You sit in on a consultation with your principal, where the client is the father of a 14-year-old boy. The father takes out his son’s cell phone and starts to explain that he suspects his child has been the victim of cyberbullying. He shows you some messages on the phone and posts on his child’s Facebook page containing threats of violence against his child, one message even states that they will “finish him off”. The father knows exactly who sits behind these threats but am unsure if there is anything that can be done about it because the cyberbully is also a child, a 16-year-old boy who attends the same school as his child. You are tasked with researching the law pertaining to cyberbullying/cybercrime in South Africa specifically where children are the perpetrators and /or the victims. You have to focus on the Constitutional rights that are at stake with cyberbullying/cybercrime and the remedies available to a child who may fall victim to cyberbullying/cybercrime. The position on cyberbullying/cybercrime in the United Kingdom will also be relevant should you choose the comparative approach (see explanation below). Write a draft research proposal for a prospective post-graduate study on the topic setting out how the law deals with such issues. Focus on the legislative framework, law reform commission reports, case law and writings by scholars.
