The historical research approach will delve into the evolution of cyberbullying and
cybercrime in South Africa, with a specific focus on instances where children are both
perpetrators and victims. This investigation will explore the Constitutional rights that are
implicated by these issues, emphasizing the right to privacy, dignity, and freedom of
expression. Additionally, the study will delve into the available remedies for child victims
of cyberbullying and cybercrime, considering legal frameworks, support systems, and
educational initiatives aimed at addressing and preventing such incidents. By tracing the
historical development, constitutional implications, and potential remedies, this research
aims to provide a comprehensive understanding of the complex interplay between
technology, children's rights, and the challenges posed by cyberbullying and cybercrime
in South Africa.
