(a) True Workers Association (‘TWA’) and Hard Workers (‘HW’) are trade unions with
members in North West Miners (Pty) Ltd (‘NWM’). TWA, which is a minority trade
union, approaches NWM regarding the acquisition of organizational rights within
the workplace. NWM, however, refuses to grant any of the rights to TWA, stating
that it can only grant organizational rights to HW, because it is a majority trade
union within the workplace.
Discuss whether NWM's argument is correct regarding the acquisition of
