This assignment consisted of two questions that you were required to answer. The questions related to
specific case studies. Your answers therefore had to relate to these practical scenarios. Answers
containing theoretical information only would have earned you limited marks.
Prior to completing this assignment, you were expected to study workbooks 05 and 06 in the study guide,
as well as the corresponding sections in the prescribed book. Please note that the feedback in this tutorial
letter should not be regarded as a model answer to Assignment 02, but simply as feedback on what was
expected of you in answering the assignment questions. Reference is made throughout to your study
material (study guide and prescribed book). You should therefore read the relevant sections in conjunction
with this tutorial letter. In some instances, additional information is also provided to explain some of the

2.2 Feedback on Question 1: Union representivity, organisational rights, agency shop
agreements and dispute resolution
This question related to the following case study:
Free riders!
The Hotel, Catering, Commercial and Allied Workers’ Union (HCCAWU) and the South African
Commercial and Catering Workers’ Union (SACCWU) had had a running battle for trade union
membership over the previous three years at establishments in the Leisure Holidays group. Both
unions had started with more or less the same membership by organising 32 per cent and 28 per cent
respectively of the employees in the bargaining unit.
For some time, there was no clear front-runner in the membership stakes until one of SACCWU’s shop
stewards was found colluding with management. He received “benefits” such as a cell phone and free
meals for discouraging members to file grievances and agreeing with the outcomes of disciplinary
hearings involving SACCWU members. Although SACCWU promptly took action against the shop
steward, they, for obvious reasons, tried to keep the matter under wraps. However, HCCAWU saw
this as an ideal opportunity to boost its membership by poaching some of the disgruntled SACCWU
