QUESTION 1 - LAWYERS AS AGENTS FOR JUSTICE

1.1 Intimidating cross-examination
Lawyers should not cross-examine witnesses in an intimidating manner because
witnesses who are subpoenaed to appear in court perform a public duty by coming
to court and should be treated with respect. Offensive, unreasonable or intimidating
cross-examination should be avoided because it detracts from the court procedure
and creates an unfavourable image with the witnesses and general public. The
presiding judicial officer has a duty to protect witnesses from such abuse.




Application to the facts
No, this will not be allowed in court, the presiding officer will have to stop the legal
practitioner from using such line of questioning as it is attacking the witness on a
personal level and not her duty as a witness before the court.


1.2 Lawyers as agents for justice
Due to the nature of the legal profession lawyers are expected to be agents for
justice who uphold the ethical rules for the profession at all times. The public put
their trust in practitioners to carry on their profession with integrity and honour.
Therefore, if a legal practitioner fails to follow the required standard such practitioner
must be held accountable by the courts. Legal practitioners must at all times be
persons of dignity, honour and integrity. The public should have confidence that
legal practitioners who fail to uphold their ethical high standards do not go
unpunished.
