, Do you think the death penalty should be brought back for criminals who
murder and rape women and children or how do you think these crimes should
be dealt with and why do you think so?
The Universal Declaration of Human Rights (UDHR) states in:
Article 1
All human beings are born free and equal in dignity and rights. They are endowed
with reason and conscience and should act towards one another in a spirit of
brotherhood;
Article 3
Everyone has the right to life, liberty and, security of person.
In terms of morality, one can argue that those who commit murder, have taken the
life of another, and have forfeited their right to life. The lives of many innocent victims
of murders can be deterred by imposing the death penalty.
Furthermore, capital punishment is a form of retribution, expressing and reinforcing
the moral resentment not only of the victim’s relatives but of law-abiding citizens in
general.
The Constitution of the Republic, 1996 stipulates in
Section 8 (1)(2)
Application
(1) The Bill of Rights applies to all Law and binds the legislature, the executive, the
judiciary, and all organs of state.
(2) A provision of the Bill of Rights binds a natural or a juristic person if, and to the
extent that, it is applicable, taking into account the nature of the right and the nature
of any duty imposed by the right;
