UNIT 1 - CORE ELEMENTS OF A JOB CONTRACT: WORKERS RIGHTS AND OBLIGATIONS, CONDITIONS OF SERVICE
LABOUR LAWS
Labour laws or legislation follow the democratic ideals of the constitution – deal with employee and employer rights
and obligations and the core elements of a job contract
LABOUR RELATIONS ACT, 66 of 1995
• Rules for relationships between employer and employee
• Promotes employee rights to fair practice (form and join trade unions) (organize and bargain collectively)
• Expects arguments and disputes to be settled through negotiations and conciliation instead of strikes
• Establishes the CCMA (Commission for Conciliation, Mediation and Arbitration) – plays a critical role in
sorting out disputes and providing advice – the Labour Court and Labour Court of Appeal decide matters
related to LRA
• Does not apply to members of the National defense Force, SA Secret Service - some of the rights are limited
when they apply to domestic workers
EMPLOYMENT EQUITY ACT, 55 of 1998
• Promotes equal opportunities by eliminating unfair discrimination in any employment policy or practice
• Regulates affirmative action so that people from the designated who have suitable qualifications are given
opportunities (Africans, coloureds and Indians, as well as women and disabled of all race)
BASIC CONDITIONS OF EMPLOYMENT ACT, 75 0f 1997
• Employers must give their employees details of their employment in writing in the form of an employment
contract
• Against the law to employ under the age of 15 years of age (except for preforming arts)
• Children aged 15-18 may not do dangerous work or work that places their well-being at risk
• Employees have duties and responsibilities towards their employers – obey all lawful and reasonable
instructions

You will be paid an ALLOWANCE for cell phone use of ALLOWANCE AMOUNT
UIF and PAYE will be deducted from your salary (DEDUCTIONS)
You will be required to work OVERTIME, from time to time, you will not be paid…in consultation with your manager
(employees must agree to work overtime – may not work more than 3 hours a day – must get paid 1,5 times their
normal pay – Sunday must get double pay – must also agree to work on a public holiday and be compensated for)
ANNUAL LEAVE information (can take 15-21 days annual leave)
