1.1 Steps or procedures that must be undertaken by an inspector when
an incident has resulted in serious injury or the death of an employee

When an incident at a workplace results in the death of an employee or
serious bodily injury, the Occupational Health and Safety Act 85 of 1993
(OHSA) requires an inspector appointed by the Department of Employment
and Labour to conduct an investigation. The purpose of the investigation is to
establish the cause of the incident, determine whether the employer complied
with health and safety legislation, and recommend measures to prevent
similar incidents in the future.

The inspector should undertake the following procedures:

1. Receive notification of the incident

The employer is legally obliged to notify the Department of Employment and
Labour immediately when an employee is killed or seriously injured in a
workplace incident. Once notified, an inspector is assigned to investigate the
matter.

2. Attend the scene of the incident

The inspector must visit the workplace as soon as reasonably possible to
inspect the accident scene. Early attendance ensures that evidence is
preserved before it is altered or destroyed.

3. Secure and preserve the accident scene

The inspector ensures that the scene remains undisturbed until the
investigation is completed, except where changes are necessary to rescue
injured persons or prevent further danger. This helps preserve physical
evidence.
