staggering 264% increase in reported kidnappings over the past decade, with an average of
approximately 50 cases documented daily in the 2023/24 financial year. While high-profile cases of
kidnapping for ransom often dominate headlines, they constitute only a small fraction of the problem.
The majority of kidnappings are perpetrated in conjunction with other violent crimes, particularly
hijackings and armed robberies.¹ This essay will explore the nature and extent of this growing crisis
by discussing five distinct types of kidnappings prevalent in SA. It will analyse the characteristics,
motivations, and contexts of these categories, drawing on available crime statistics and expert
analysis to provide a comprehensive overview of this complex security risk. The discussion will
encompass express kidnappings, ransom kidnappings, kidnappings linked to other crimes such as
robbery and hijacking, the culturally rooted practice of ukuthwala, and political kidnappings.

Definition of Kidnapping
In South African law, kidnapping is defined as the unlawful and intentional deprivation of a person's
freedom of movement.² When the victim is a child, the crime also encompasses the unlawful and
intentional deprivation of a parent or guardian's control over that child.³ This definition distinguishes
kidnapping from abduction; while kidnapping involves the removal of a person against their will for
any reason, abduction specifically refers to the unlawful removal of an unmarried minor from the
control of a parent or guardian with the intent to enable marriage or sexual intercourse.⁴ Therefore,
kidnapping is an invasion of personal liberty, inflicting mental anguish and exposing the victim to
the risk of physical harm or even death.⁵
