Question 1 (20 Marks)

1.1 Five principles of co-operative government (Section 41, Constitution) (5)

• Preserve the peace, national unity and the indivisibility of the Republic.

• Secure the well-being of the people of the Republic.

• Provide effective, transparent, accountable and coherent government for the Republic
as a whole.

• Respect the constitutional status, institutions, powers and functions of government in
the other spheres, and not assume any power or function except those conferred on
them in terms of the Constitution.

• Exercise their powers and perform their functions in a manner that does not encroach
on the geographical, functional or institutional integrity of government in another
sphere.

• Co-operate with one another in mutual trust and good faith, including by fostering
friendly relations, assisting and supporting one another, informing and consulting one
another on matters of common interest, and co-ordinating their actions and legislation
with one another.

(Constitution of the Republic of South Africa, 1996, s 41(1)). Candidates should select and
list any five of the above.

1.2 Role of the Public Protector (5)

The Public Protector is one of the Chapter 9 institutions established to strengthen
constitutional democracy. Its core mandate, set out in section 182 of the Constitution and
expanded on in the Public Protector Act 23 of 1994, is to protect the public against
maladministration and abuse of power in state affairs.

• Investigation: The Public Protector has the power to investigate any conduct in state
affairs or in the public administration in any sphere of government that is alleged or
suspected to be improper or to have resulted in prejudice to a member of the public.
