2.1 Suspension and Expulsion from Public Schools



According to the South African Schools Act (No. 84 of 1996), suspension and expulsion
are serious disciplinary measures with specific legal procedures that must be followed
to protect learners' rights.



Suspension: After a fair hearing, the school governing body may suspend a learner from
the school for no longer than one week (Study Guide, p. 30). A suspended learner is not
permitted to attend school during this period. The suspension must follow a proper
disciplinary process where the learner has an opportunity to be heard. A learner
attending disciplinary proceedings must be accompanied by a parent or suitable adult,
unless good cause is shown for their absence (Study Guide, p. 30).



Expulsion: Only the Head of the Education Department may expel a public school
learner, and this can only happen for serious misconduct assessed at a fair hearing
(Study Guide, p. 31). Expulsion is a more severe consequence than suspension and
cannot be imposed by the school governing body alone. Learners have the right to
appeal expulsions through the provincial Department of Education.
