, Question 1:

Only blood relations inherit intestate from the deceased.1 When a marriage ends in
divorce, the blood relation also ends. Descendants always inherit before ascendants
and collaterals.2


Xavier’s estate:
They were married out of community of property. According to Minister of Justice and
Constitutional Development, a surviving spouse are entitled to R250 000 or he will
inherit a child’s portion, whichever is bigger.3
R500 000 + R100 000 = R600 000
R600 000 ÷ 3 (Ben, Evert and Xavier) = R200 000 each
Xavier will inherit R250 000 as it is more than R200 000.
