The debt is secured by a mortgage bond registered over the hotel. A guest of the hotel, Annie, accidentally packed a towel that looked like her own into her suitcase, honestly believing that it was hers, before leaving the hotel. One of the hotel’s chefs, Sipho, asked Thandi whether he could rent one of the small rooms in the hotel for a period of six months. Thandi agreed, and they concluded a lease agreement. Sipho also asked Thandi to borrow R5 000. They agreed that Sipho would pledge his cell phone as security for the loan. Thandi paid the R5 000 into Sipho’s bank account, but both parties agreed that it would not make sense for Sipho to hand the cell phone to Thandi. holder". In your answer, specifically refer to the relevant thing(s) of which he/she
is a lawful holder.

Sipho is a lawful holder of the small room he rented from Thandi. A lawful holder
exercises physical control with the intention to derive a benefit (animus ex re
commodum acquirendi) based on a legal relationship, such as a lease agreement
(Scott, Property Law Study Guide 157). Sipho's control and intention to use the room for
his benefit, rooted in the contract with Thandi, establishes his lawful holdership, as
illustrated in Scholtz v Faifer 1910 TS 243
