LCP4807 ASSIGNMENT 2 2026

DUE MARCH 2026

Can the DAA take this case to the African Commission on Human and Peoples’
Rights? Regardless of whether your answer is yes or no, provide a critical
analysis taking into consideration the procedural issues, possible rights that are
violated in terms of the Charter, substantive issues, and the possible remedies.

1. INTRODUCTION

You have requested an opinion on whether your organisation, Developed
Afrika for All
(DAA), can take the case of Mr. Martin Ricardor and the community of
Magadi to the
African Commission on Human and Peoples’ Rights (the Commission). The
case concerns the Republic of Sofala's alleged failure to provide basic
necessities such as clean water, schools, roads, and health facilities,
despite Mr. Ricardor's decade-long pursuit of domestic remedies,
culminating in a dismissal by the Constitutional Court based on budgetary
constraints.
