QUESTION 1

Thabo died intestate in 2025, leaving an estate valued at R2 100 000. As his
marriages to Anna, Basetsana and the late Dinah were concluded in terms of
customary law, they are recognised as valid marriages. The devolution of his
estate is governed by the Intestate Succession Act 81 of 1987, as amended and
applied through the Reform of Customary Law of Succession and Regulation of
Related Matters Act 11 of 2009. This framework ensures that surviving customary
spouses in a polygamous union are treated as “spouses” for intestate succession
purposes.

Applicable Legal Provisions

Since Thabo is survived by spouses (Anna and Basetsana) and descendants,
section 1(1)(c) of the Intestate Succession Act applies. Each surviving spouse is
entitled to the greater of a child’s share or the statutory minimum amount (currently
R250 000). The residue of the estate then passes to the descendants per stirpes
(by representation).
