1. Introduction

A public school and its governing body exercise public power and must act lawfully,
reasonably and procedurally fairly.2 The EDL3703 study guide similarly treats due
process, lawful punishment and constitutional rights as central requirements of
learner discipline. The whipping and expulsion decisions must therefore be assessed
separately, although both arose from the same incident.

2. The right to a basic education

2.1 Constitutional protection

Section 29(1)(a) of the Constitution provides that everyone has the right to a basic
education, including adult basic education.3The word everyone gives the protection
broad application and includes learners who have committed misconduct. A
disciplinary offence may justify lawful suspension or expulsion, but it does not
remove the learner from the protection of the Bill of Rights.

The right is closely connected with equality, dignity and children’s
development.4Education equips learners for further study, employment,
