Question 1: LAND ISSUES PRINCIPLES, LEGISLATION AND CASE LAW
(1) Which legislation is applicable to the eviction of people from buildings that are
unsafe or unhealthy? (2)
The applicable legislation is the National Building Regulations and Building
Standards Act 103 of 1977 as well as the Prevention of Illegal Eviction from and
Unlawful Occupation of Land Act 19 of 1998 (PIE Act).
The National Building Regulations Act addresses unsafe or unhealthy buildings,
while the PIE Act governs the lawful eviction of unlawful occupiers, ensuring that it is
done in a just and fair manner.
(2) Under the legislation mentioned in question (1), who has the authority to
ensure that all buildings that are unsafe or unhealthy are altered or renovated to
render them safe or healthy for human habitation? (2)
In terms of the National Building Regulations and Building Standards Act, the
authority rests with the local authority or municipality, specifically the building
control officer appointed by the municipality.
The municipality has the power to instruct the owner to make necessary alterations or
renovations, or to take steps to prohibit occupation until the building complies with
safety and health standards.
