ziekte en arbeidsongeschiktheid
1. Lees het krantenartikel over Catharina (zie BB). Stel het UWV besluit dat omscholing een
goed instrument is om haar weer naar de arbeidsmarkt toe te leiden. Bestaat er recht op
scholing binnen de Wet WIA?
p. 394 Art. 1 begrippen. Er bestaat recht op Scholing binnen de wet WIA.
2. Stel. Catharina vindt scholing geen goed idee. Wel wil ze graag een jobcoach; iemand die
haar ondersteunt bij het vinden van werk. Zij vindt dat ze recht heeft op ondersteuning bij
haar arbeidsinschakeling op grond van de Wet WIA.
a. Geef aan of Catharina in het algemeen recht heeft op ondersteuning?
Art. 34. Lid 1. WET WIA. Heeft het over complete ondersteuning. Beleidsregels; scholing 2021 wat zijn
de voorwaarden etc.
b. Stel dat het UWV aangeeft dat de situatie van Catharina op dit moment nog zo
ernstig is dat geen re-integratieinstrument wordt ingezet. Kan Catharina deze
beslissing aanvechten?
Ze moet eerst in bezwaar. Bij het UWV. Artikel hoeft er niet bij als je de weg weet uit te leggen. Eerst
in beroep bij de rechtbank. Afdeling bestuursrecht.
Eerste juridische stap is bezwaar. Daarna gegrond of ongegrond. Daarna kun je nog in beroep gaan.
In hoger beroep kan je bij vele instanties.
c. Krijgt Catharina haar jobcoach?
De voorwaarden voor het krijgen van de jobcoach is: Artikel 35 lid 2, sub d. Noodzakelijke persoonlijke
ondersteuning bij het verrichten van de aan de persoon opgedragen taken, indien die ondersteuning
een compensatie vormt voor zijn beperkingen. Kijken naar wat haar beperkingen zijn.
3. Catharina kan op de proef aan de slag.
a. Geef de Wet WIA hiertoe de mogelijkheid?
Artikel 37. Wet WIA. LID 1
b. Zo ja, hoe lang kan een proefplaatsing duren
Maximaal 6 maanden onbeloonde werkzaamheden verrichte. Dit betekent met behoud van uitkering.
