The criminal justice system faces gender-based discrimination that creates significant obstacles in providing equal access to justice for everyone. The question of whether the criminal justice system treats men and women equally is an active area of debate, owing to the fact that gender bias supports the preferential treatment of women by the judicial system. Gender disparity in the criminal justice system raises a concern as to why men are more likely to get the death penalty or how women are treated leniently during sentencing. A bias against men in the criminal justice system is characterized by the fact that men are more likely to face arrest and suffer longer sentences based on the claim that males are more violent and risk-takers than women. Generally, women are treated more leniently than men are in various aspects of the criminal justice system, citing the disparities in "sex differences" (Van Wormer & Bartollas, 2022). The basic principle of justice revolves around fairness to everyone regardless of gender, but then, the disparities spark a debate about handling sentences based on gender. Although the number of women in prison is growing faster, the criminal justice system frequently focuses on the prerequisites of a predominantly male population of convicts in prisons (Van Wormer & Bartollas, 2022). The preferential treatment accorded to women is discriminatory to the male counterparts subjected to harsher sentences and denied bail, further stretching the gender gap and bias. However, there is an argument to claim that women are more remorseful and less dangerous than men, justifying the harsher treatment accorded to them as they are more likely to breach court orders. Clearing up on the gender disparity concern in the criminal justice system requires thorough scrutiny of the justifications for the contrasting treatment of male and female offenders.
