Ordinances by local units of government that prohibit hair braiding, hair braiding services, or hair braiders, as defined in subparts 10a to 10c, or regulate any matter relating to licensing, testing, or training of hair braiding, hair braiding services, or hair braiders are preempted by this part. Board purpose and responsibilities - Answer- 155A.20 BOARD OF COSMETOLOGIST EXAMINERS CREATED; TERMS. (a) A Board of Cosmetologist Examiners is established to consist of seven members, appointed by the governor as follows: (1) two cosmetologists, one of whom is recommended by a professional association of cosmetologists, nail technicians, and estheticians; (2) two school instructors, one of whom is teaching at a public cosmetology school in the state and one of whom is teaching at a private cosmetology school in the state; (3) one esthetician; (4) one nail technician; and (5) one public member, as defined in section 214.02. (b) All cosmetologist, esthetician, and nail technician members must be currently licensed in the field of cosmetology, nail technology, or esthetology, in Minnesota, have practiced in the licensed occupation for at least five years immediately prior to their appointment, be graduates from grade 12 of high school or have equivalent education, and have knowledge of sections 155A.21 to 155A.36 and Minnesota Rules, chapters 2105 and 2110. (c) Membership terms, compensation of members, removal of members, the filling of membership vacancies, and fiscal year and reporting requirements shall be as provided in sections 214.07 to 214.09. The provision of staff, administrative services, and office space; the review and processing of complaints; the setting of board fees; and other provisions relating to board operations shall be as provided in chapter 214. (d) Members appointed to fill vacancies caused by death, resignation, or removal shall serve during the unexpired term of their predecessors. 155A.21 POLICY. The legislature finds that the health and safety of the people of the state are served by the licensing of the practice of cosmetology because of infection control and the use of chemicals, implements, apparatus, and other appliances requiring special skills and education. To this end, the public will best be served by vesting these responsibilities in the Board of Cosmetologist Examiners. 155A.24 ADMINISTRATION. Subdivision 1.Board's powers and duties; generally. The board has the power and duties necessary for the administration of the provisions of this chapter. Subd. 2.Hiring and assignment of employees. The board has the authority to hire qualified personnel in the classified service to assist in administering the law, including those for the testing and licensing of applicants, conducting inspections, and complaint investigations. 155A.31 INSPECTIONS. The board is responsible for inspecting salons and schools licensed pursuant to sections 155A.21 to 155A.36 to assure compliance with the requirements of sections 155A.21 to 155A.36. The board shall direct board resources first to the inspection of those licensees who fail to meet the requirements of law, have indicated that they present a greater risk to the public, or have otherwise, in the opinion of the board, demonstrated that they require a greater degree of regulatory attention. Licensing - Answer- A person must hold an individual _____ License License Cycyle to practice in the state as a cosmetologist, esthetician, nail technician, eyelash technician, advanced practice esthetician, manager, or instructor. Display of License - Answer- Every holder of a license granted by the board shall display it in a conspicuous place in the place of business. New services or devices - Answer- Before providing any service using a product, technique, device, or equipment new to the licensee, the licensee must: A. ensure that the use of the product, device, or technique is within the licensee's scope of practice; B. review and comply with any manufacturer's directions for use, safety requirements, and contraindications; C. maintain a record of any training received by the licensee on the product, technique, or device, for as long as the licensee is using the product, technique, or device; and D. attest that the licensee has the knowledge and training necessary to safely provide the service using the new product, technique, or device. address - Answer- The licensee must maintain a current mail _____ on file with the board, and must update the _____ within 30 days of any address change. Licensees may also provide an e-mail address to receive general e-mail notifications from the board. Salon Manger - Answer- An applicant who holds an active Minnesota operator license and wishes to advance to a _____ _____ license must: (1) submit a completed application form; (2) document at least 2,700 work hours of licensed experience in a licensed salon within the three years prior to application; (3) submit original passing test results of the salon manager test no more than one year old; and (4) pay the fees practitioner - Answer- An applicant who holds an active salon manager license and is applying for a _____ license in another field may apply for a salon manager license in the new field without first obtaining or paying for an operator license in the new field. An applicant must: (1) submit a completed application for the new field and meet the requirements for the operator license; and (2) pay the fees Instructor - Answer- An applicant for an _____ license must: A. submit a completed application form; B. hold an active Minnesota license as an operator or manager; C. document at least 2,700 hours of licensed practice in the same licensure field as the instructor license type sought within the three years prior to application; D. submit the original course completion certificate of a board-approved instructor course on teaching methodology not more than one year old; E. submit original passing instructor test results not more than one year old for the instructor general theory, practical, and laws and rules tests; and F. pay the fees School Manager - Answer- An applicant for a _____ _____ license must: A. submit a completed application form; B. hold an active Minnesota cosmetology salon manager license; C. submit original passing results no more than one year old of the school manager test covering Minnesota laws and rules related to schools; and D. pay the fees Advance - Answer- An applicant who holds an active salon manager license in one field and an active operator license in another field may advance the operator license to a salon manager license without meeting the requirements of item A, subitems (1) and (2). An applicant must: (1) submit a completed application; and (2) pay the fees Renewal - Answer- All licenses expire on the last day of the individual's birth month of the year due. If more than three years have passed since the expiration date of the license, the license is not eligible for _____ and the requirements of part 2105.0215 apply. Continuing Education - Answer- Complete 4 hours of continuing education credits - 1 hour: instruction pertaining to state laws and rules governing the practice of cosmetology. - 3 hours: instruction pertaining to health, safety, and infection control matters consistent with the United States Department of Labor's Occupational Safety and Health Administration standards applicable to the practice of cosmetology, or other applicable federal health, infection control, and safety standards, and must be regularly updated so as to incorporate newly developed standards and accepted professional best practices. Licensing - Answer- A person must not offer cosmetology services for compensation unless the services are provided by a licensee in a licensed salon. Each salon must be licensed as a cosmetology salon, a nail salon, esthetician salon, advanced practice esthetician salon, or eyelash extension salon. A salon may hold more than one type of salon license. Unlicensed persons - Answer- Salons must not employ or allow unlicensed persons to perform any board-regulated service in a salon, or allow an unlicensed person to provide regulated services without compensation. Compliance - Answer- The licensee must comply with all applicable provisions of Minnesota Statutes and Rules. Maintain insurance - Answer- The salon must maintain any required workers' compensation insurance and professional liability coverage for the salon and salon employees. If the salon leases space to any licensee, or contracts for services with a licensee, the salon must ensure that the licensee is covered under the salon's professional liability insurance or that the licensee maintains current professional liability coverage meeting the salon requirements. Salon premises - Answer- Regulated cosmetic services must not be provided in a place other than a licensed salon or licensed school, or as otherwise provided by this chapter. Change of location - Answer- A salon license must not be transferred when the salon moves to a new location. The salon must apply for a new salon license and has 60 days after a move to become licensed. If a new license has not been issued by day 61, the salon must cease operations until a license is issued. A mobile salon moving to a new vehicle or new mobile structure must not begin operating in the new vehicle or new mobile structure until the new mobile salon has been issued a license. Change of name - Answer- This part applies only to salon name changes and does not apply to changes of ownership. The board must reissue the salon license in the new name under the same license cycle after the salon owner has met the requirements of this subpart. Within 60 days of the name change, the salon owner must: A. submit a salon name change form to the board; B. provide legal documentation of the name change and any other documents the business is required to file with the secretary of state under state law because of the name change; C. provide a certificate of insurance showing the salon's new name for professional liability insurance; D. provide a certificate of insurance in the new salon name for workers' compensation insurance if applicable; and E. pay the fees Change of owner - Answer- A salon license must not be transferred when the salon is sold, or when a corporation owning a salon is sold. The salon must apply for a new salon license and has 60 days after change of ownership to become licensed. If a new license has not been issued by day 61, the salon must cease operations until a license is issued. Change of Business Structure - Answer- A salon license must not be transferred when the business structure of the owner is changed. The salon must apply for a new salon license and has 60 days after the change of business structure to become licensed. If a new license has not been issued by day 61, the salon must cease operations until a license is issued. Change of DLSM - Answer- The salon owner must inform the board in writing within ten business days of the departure or resignation of the DLSM. The salon has 60 days from the date of the change to register with the board a new DLSM meeting the requirements. Residential salons - Answer- A salon shall not be located in a room used for residential purposes. If a salon is in the residence of a person practicing cosmetology, the rooms used for the practice of cosmetology shall be completely partitioned off from the living quarters. Mobile Salon - Answer- Requirements for _____ _____. In addition to complying with the requirements for a salon, the holder of a salon license must: (1) maintain a permanent business address; and (2) notify the board of the locations and schedule of operation of a mobile salon. Salon Requirements - Answer- The conditions and process by which a salon is licensed shall be established by the board by rule. In addition to those requirements, no license shall be issued unless the board first determines that the conditions in clauses (1) to (5) have been satisfied: (1) compliance with all local and state laws, particularly relating to matters of infection control, health, and safety; (2) the employment of a manager, as defined in section 155A.23, subdivision 8; (3) if applicable, evidence of compliance with workers' compensation section 176.182; and (4) evidence of continued professional liability insurance coverage of at least $25,000 for each claim and $50,000 total coverage for each policy year for each operator. Special event services - Answer- Services rendered for compensation and performed at a location other than a licensed salon. These services are limited to the practice of nonpermanent manipulation of the hair, including: styling, setting, reinforcing, or extending the hair; the application of nail polish to the nails; and the application of makeup to the skin. Special event services permit - Answer- No person shall perform special event services without first obtaining a _____. To be eligible for a special event services permit, a person must have a valid manager's license.
