Criminology unit 4 AC 1.3 - Describe the models of criminal justice Q&A 2023 Update A+ The two models of criminal justice - ANS-In 1968 Herbert Packer described two contrasting sets of values that shape the way a criminal justice system works: The crime control model of justice. The due process model of justice. The crime control model - ANS-As crime is a major threat to freedom this model focuses on apprehension, punishment and the suppression of crime. Prioritises catching and punishing offenders as a deterrent for future crime, as opposed to tackling the root cause. Prioritises the rights of victims and society to be protected from crime as opposed to rights of suspects. The crime control model - ANS-Starts with a presumption of guilty immediately - if police charge someone and investigate them they are presumed to be guilty straight away. This reflects the 'assembly line' or 'conveyor belt' justice that this model wants - its desired to process cases quickly and efficiently with speedy prosecution, conviction and punishment. (Aware that there are few miscarriages of justice but believe this is inevitable) The due process model - ANS-Power of the state is the threat to freedom. Want to protect the accused from oppression by the state. Do not have faith in the police, for example, conducting satisfactory investigations and so believe that more care is needed to prevent miscarriages of justice.
