Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof
except in accordance with the principles of fundamental justice.

to be secure against unreasonable search or seizure.

(a) to be informed promptly of the reasons therefor;
(b) to retain and instruct counsel without delay and to be informed of that right; and
(c) to have the validity of the detention determined by way of habeas corpus and to be

Answers Any person charged with an offence has the right
(a) to be informed without unreasonable delay of the specific offence;
(b) to be tried within a reasonable time;
(c) not to be compelled to be a witness in proceedings against that person in respect of the

(d) to be presumed innocent until proven guilty according to law in a fair and public hearing by
an independent and impartial tribunal;
(e) not to be denied reasonable bail without just cause;

five years or a more severe punishment;

Arrest without warrant by any person; Section 494, Criminal Code (1) - Answers Any one may arrest
without warrant
(a) a person whom he finds committing an indictable offence; or
(b) a person who, on reasonable grounds, he believes
(i) has committed a criminal offence, and
(ii) is escaping from and freshly pursued by persons who have lawful authority to
arrest that person.

lawful possession of property, or a person authorized by the owner or by a
person in lawful possession of property, may arrest a person without a warrant if they find them
committing a
criminal offence on or in relation to that property and
(a) they make the arrest at that time, or
(b) they make the arrest within a reasonable time after the offence is committed and they
believe on reasonable grounds that it is not feasible in the circumstances for a peace
officer to make the arrest.
