Fundamental Penology

Question 1: Compare the concepts of general and specific deterrence in Mr X’s
case, and justify the deterrence that you think would apply in Mr X. (25 marks)

1. Introduction (2–3 marks)

Deterrence is a key goal of punishment aimed at preventing crime either by
discouraging the individual offender or society at large. There are two types: general
deterrence, which aims to discourage the public from committing crimes, and specific
deterrence, which targets the individual offender.

2. General Deterrence (7–8 marks)

 Definition: General deterrence seeks to prevent potential offenders in the
broader society from engaging in criminal behavior by making an example out of
the punished individual.
 Application in Mr X’s case:
o His conviction and sentencing could serve as a warning to others in his
community that criminal acts like armed robbery lead to harsh
consequences.
o By sentencing Mr X to 10 years, the justice system may aim to show that
such offenses are taken seriously.
