Case Study 2, The Negligent Hiring/Retention Case.
Introduction
The case study deals with a firm called Personally Yours, a personal assistant firm founded in
1997 (Hall, 2009). They provide services including housekeeping, household organization, and
grocery shopping. It started as a family business but they have expanded into 15 branch offices
and headquarters in Tampa, Florida (Hall, 2009).
For this case study, I chose the role of HR manager, Alyssa Williams, and analyze the issues
with this in mind. The reason for choosing is that she has more experience, control, and freedom
to decide what matters. The decisions will be done in consultation with Sarah Winters the
owners, Gary Garcia, HR supervisor, and Violet Jennings, Tampa-East branch manager as
needed.
Case Analysis
The first issue is to determine whether to do a background check on all employees and to
develop a protocol to conduct them. Every company needs to determine the liability that it
carries and its impact. As an HR manager, the liability that is attached to employees regarding
their work should be analyzed properly.
Background checks include reference checks, resume verification, social media checks, criminal
checks, and credit background checks (Seah, 2021). The crucial aspect of background checks is
to make sure that the information gathered from employees is strictly required for Job-related
purposes. Background checks help us to protect the firm, employees, and customers from any
liability caused by an employee (Seah, 2021). It also helps our company avoid negligent hiring
claims which are especially true for this firm where employees enter private living areas and
meet vulnerable people like children and the elderly.
